Know your rights, the police have to get a warrant before they can conduct a blood test. Drunk driving is stupid, it doesn't mean you should get fucked for life, which is what happens.

 

If you have one or more DWI's the best bet is to refuse to take the test. Auto license suspension, but better than another DWI.

If you think you are on the bubble you can always refuse and hope that by the time they DO get a test out of you that you drop.

Why a blood test? I've never heard of this. WTF, falling over and failing a breathalyzer isn't enough, they need blood work too?

Limits exist in the law. You don't have to be blacked out to get a DUI. You can just be one beer over and make a driving mistake (or have a cop just make up a reason to pull you over.)

Breathalyzers need calibrated and police departments don't keep up with them always. They can also be thrown off in different ways. (mouthwash makes them go up, charcoal makes them go down) Blood work, however, is definitive.

I think DD is absolutely horrible, but the limit is pretty low right now. People have a couple glasses of wine and drive home and get fucked. A DUI/DWI is a nuclear bomb on your career right now. Plus, at least in NYS, you cannot plea it down below an alcohol related offense. So even if you are right on the bubble and even if this if your first, you are fucked.

 

Breathalyzers also do not disclose their metrics or inner workings. Plenty of people have fought arrests and claim that the breathalyzer is faulty and request to see how it works, which producers of these devices refuse to give.
