We Want Prenup?

I came across a BI article about the advantages of getting a Prenup (less lawyers involved in the divorce, discuss terms before you get sick of each other, etc.).

"To people who are considering marriage, I highly recommend a prenuptial agreement," says Katie Gampietro Burke, CFP at Wealth by Empowerment. "Unfortunately, most marriages end in divorce. So why not have that conversation when you can have the conversation? Not necessarily who's going to get the house, but the financial side of things."

Though many fear that getting a preup is simply about planning for, or even expecting, a worst-case scenario, a couple's need for a prenup isn't based solely on their income or assets. According to Terry Savage, coauthor of "The New Love Deal: Everything You Must Know Before Marrying, Moving In, Or Moving On!," the real benefit of a prenup applies to any relationship: upfront, honest communication.

I figured a community of well-off (or prospectively well-off) individuals like yourselves could provide some interesting takes on the subject... Any thoughts? I'd love to hear some personal anecdotes if possible.

I know somebody paying child support for one of his kids, the child's mother's car and home are bigger than his. This guy was so well to do you could see his Beemer on Church on Sunday, he could Win the Bonus Pool and drive off in a Hyundai. With the funds from the prenup she was supposed to buy your child toys with your money, as outlined, instead she went to the doctor got lyposuction with your money. Now his wife is walking around looking like a baller, and all with your hard earned cash. It would have been better to have your cash locked up in an insurance policy with your money.

If you are not a fool then you must vigorously and vociferously ask for a prenup! It is something so indispensable because when she leaves your ass or vice versa she will be departing with half of your assets. Plus you could be paying child support for 18 years and find out your kid isn't even yours.

From my understanding a lot depends on the state you're in (see how celebrities/sports stars often file for divorce in weird states). For example, CA has much more favorability to the lesser income party - after 10 years its no fault divorce. An attorney friend once told me a lot has to do with commingling of assets. I think things you earn while married might be harder to desegregate but things you had before marriage are easier to keep separate (inheritance for example). However, I believe he said a major caveat was not mixing accounts - basically even if a penny pierces the corporate vail so to speak you lose standing. So basically while you're married you need not let your wife ever have access to certain accounts - though that in it self will likely lead to divorce, ha.
