Last Night's White Collar

So I just finished watching this past Tuesday's white collar. Pretty good episode, but did anyone else think it was a major plot hole that Neil didn't try to bang Sophie (the blonde chick)? Maybe I'm nit picking but it seems like there is only one clear option in that situation...

 

Or that when he transferred $45 million to the criminal, the guy didn't just kill him instead of letting him walk. Neal won't bang someone to jeopardize a case. That's the premise. He's good with women, but he stays in control enough to not get too deep. Anyway...he can just bang Sara (red-haired insurance investigator).
