Misdemeanor for IB jobs
I am writing in regard to a misdemeanor charge the I received over the weekend. I was arrested for a minor in possession (MIP) of alcohol. I blew a high, so it's likely to stay on my record.
I am wondering if I will need to disclose this when applying for jobs at BB investment banks? And if so, will it be an instant 'ding'?
Also, what are the ramification if I do not disclose an MIP on internship/job applications? I have heard most large banks typically do a background check after interviews and before offers. If they found out I didn't disclose it will my offer be revoked?
I know it's a sticky situation, and I know that I am an idiot for getting myself into legal trouble as a minor. However I have often found that it is sometimes easier to ask for forgiveness than permission.
Any help/advice would be greatly appreciated.

You do not have to disclose this on an application. If you do get hired you might have to disclose it but it depends on the situation. If you get a lawyer and get it expunged or dismissed or somehow reach a deal with the prosecutor you probably won't even have to disclose it as it won't pop up on a background check.
I have already talked to a lawyer, and he said it will probably NOT be expunged or sealed... So what you're saying is that most BB IB typically only ask for Felonies? Or what do they typically ask?

That is because the charges are more severe if you repeat offend. I.E. you can't get a coke-to-lower charge expunged because if you repeat they want to know you have been caught before. However, after you are 21 you cannot get an MIP, so i do not see why it wont be then.
That said, my MIP was dismissed after I took an alcohol abuse class. I never disclose it however it has come up from HR for every job offer i have received. I get the feeling the do not care but they have to ask.
They do ask about misdemeanors, but yours will probably be pleaded down if it is the first. Technically, you should still disclose but it is VERY easy to play stupid and say you did not plead guilty to the misdemeanor, you thought the charge was dropped, etc..

Most of these misdemeanor charges are sealed after a few years, or after you become 21 I believe. Unless you plan on getting a job in IB before you graduate college?
Where do you live? Where I'm from you just have to do a bit of community service, take a class, or a pay a fine and they dismiss it. DUI is where you have real problems, but usually companies don't care as long as you're not applying for a driving position.

you will have to disclose on U4 but don't think this will get in the way of you obtaining FINRA license
When I put in my FINRA forms they found: 1) Criminal damage to property, 2) MIP in state #1, 3) 2nd MIP in state #2, 4) public urination, & 5) posession of fake i.d. My boss called me a dumb ass. I got all my Series licenses. Life went on.
Similar situation, criminal property damage. My charges were withdrawn and no conviction. I get that these came up and it was no big deal, but did you disclose? And we’re you convicted?
You'll be OK. Save the alcohol related charges for after you get hired.
i got one of those damn things junior year. i actually dont even know what i got charged with. i had a beer in my hand and lost track of where i was standing and the second my foot left the property the cop swooped in like a scavenger to get me. fukin asshole. anyway, im assuming thatd b MIP (i was 20). wanted to fight it but my mom mailed the $ in before the date w/out tellin me. in retrospect dont really c wat my argument wudda been anyway, lol. btw is it just me or is getting a lawyer for sumtin like this wayyyyyyyyy excessive
sk247365---So you had your case dismissed after probation, but they still found out about it? How is that possible? I feel like you should be able to sue the court/your lawyer if it was intended to be 'Non-Public' information
And what did HR say? Did they just want you to admit that you had an MIP and explain how you saw the light? Or did they make you explain in detail how you (i) was a jackass?
Poff--was this by any chance a larger firm? I feel that a BB would be more strict than your local shop.

So, I recently got an offer at BB in the UK, though I went to school in the US. In my final year I was charged for possession of drug paraphanalia, a simple misdemeanor (they found papers, that i used for cigarettes, and the cop was an asshole). Charge was obviously dismissed and now they want to know in one of the forms if I was ever 'charged or cautioned for a criminal offence'...
Can I get away with ticking no or should I just admit it. will they take away my offer if I do?

I say call your local police departmernt (use the non-emergency number) and ask how these dismissals are processed. Dispatchers can be pretty helpful. That would probably be the next best thing aside from asking a lawyer. Sure it's no big deal, but if it were up to me I would want to be 100% sure there is no trace of that incident on my any of my records.
"Charged or cautioned" means you actually did something bad but I don't think you have to disclose anything about a "dismissal". If you're paranoid like me, just do that cop thing...

Thanks for the quick response. I know it shows up online in the state courts website if you put in my full name but not if you search by county. I guess the question is if it does come up on my background check (and it was in a different country, though i will obviously tell them my old address) could i get away with saying something like 'Oh i didn't think it applied since it was hardly anything, and didn't even know it went further than my interaction with police [because of how absurd the situation was]'

You need to check YES moron. Its pretty black and white.....disclose if and youre fine, hide it and you are DONE.
Call up your lawyer, send them the question exactly as it is asked, and find out what you should put. This way (a) you get a professional opinion; (b) if HR calls, you can direct them to call your lawyer.
In the U.S. charged simply means accused. I'm not sure if legal definitions are different from country to country but if they are, you would most likely have to check the box. If it asks if you were convicted, however, you would not as the charges were dismissed.

I got fucked by the law last weekend, called hr asap, they didn't care and were happy I disclosed it. And I actUally did do something wrong lol. I had already cleared my background check.
