Financial Services with a Misdemeanor Record

Similar questions have been asked. None are directly relevant to my situation. I expect to run into issues along the way, know overall persistence and developing a solid track record is key. However, after 2 rounds of extremely positive interviews, loving the company and the people I've met...The offer is off the table.

I have a few misdemeanors from a 7 years ago. Resisting arrest and unlicensed firearm possession (moved from out of state.) The prosecutor demanded I dotime. Did 2 years, during which I read as much as possible, mastering Economics textbooks. From there proceeded to wrapping up my Bachelors Degree. The state where I live, doesn't allow expungment. The convictions can be sealed within a matter of months....at a significant cost.

Should I just avoid the financial industry altogether? Most all job openings in my city, are by financial firms. I work in the technology sector.

I'm asking to be strategic in my efforts. Any advice is appreciated.

 

Depends on bank. Some banks make you disclose arrests. Also sometimes the regulators care more than the banks (depending on where you are)

 

I don't know if they really give a crap about misdemeanors and minor stuff like that as long as it's not related to securities or any type of financial crime. It's banking not the monestary, I'm sure plenty of these cats got into all kinds of shenanigans back in their college days. Any one know for sure if they care about this minor stuff?

 

I understand your point, anonymo, but does HR really have that much pull in deciding who gets a full-time offer? They're the ones who will see your BR Check, the bankers are the ones who will see your performance, does HR really trump the actual bankers in deciding who gets the offer?

 

HR has very little say concerning who gets an offer, but I'm pretty sure your background check will be done before you start your internship. So if anything, they'll rescind your SA offer.

 

Sorry, I was misunderstood. I don't think they'll rescind the offer. I agree with Paulsonator, I think you'd find plenty of people in banking with misdemeanors and other minor infractions. (I have one). The original poster was asking how it would affect him getting the full time offer, and my point was if HR was going to do anything about it, they'd probably take away the internship. They're not going to let you start working, and then not give you an offer because of a misdemeanor.

 

Regarding the full time offer question: it really depends on your company's policies, but I agree with the others that a misdemeanor shouldn't affect your chances of getting a full time offer. And either way, you need to perform well over the course of your internship, and there's not much you can do about it now. So don't worry too much about it.

However, you might want to check to see if your misdemeanor charge stays on your record permanently. If it does, make sure you don't answer "no" to the "have you ever been arrested for any crime" or any such question when applying for jobs in the future. Otherwise you'd be lying, and they always ding people for that.

 

When they ask, you tell. If they don't ask, you don't tell.

You are not required to disclose every negative thing about yourself. You probably didn't tell them about the time you pissed your pants in Kindergarten, did you?

I see answers like the first comment and the second and its conflicting. I want to be upright honest with them but I don't want to bring light and attention to something they didn't ask for

 

I'm in the same boat as you, got arrested for 19 counts of M3 Invasion of Privacy, M3 Harrassment and M1 Stalking about a month ago, long after I sent out all my documents. My hearing hasn't happened yet but my lawyer was able to figure out a plea deal so they're going to chalk me up for summary offenses. It helped that I was cooperative during the investigation and it was my 1st offense, albeit quite serious.

Has your company completed a background check already? My company just started the screening process (they sent me an email saying the agency will call me asking for confirmation of birth date) so I told them everything and am hoping they won't rescind my offer. If you know your company hasn't started background checks yet, I would advise you to let them know before they hear it from the background screening agency they hire. Good luck man.

 

I wouldn't say anything extra. Whatever disclosure form you signed was valid as of that date, so you didn't lie. There's nothing to be gained by attracting attention to the problem. Generally, the disclosure form only asks if you have been convicted, not arrested; obviously, you don't have a disposition yet, so you can truthfully say you have not been convicted.

Whether the catch you and care is a different question. If we're talking about a MIP or DUI I don't think it will be a problem either way. If it's something more serious that was either violent or calls into question your ethics, i.e. theft, then your offer is definitely at risk.
