Need some advice, worried my internship offer may get rescinded

So I recently received an offer for an internship set to start in may, but it requires a background check, which I was told is pretty extensive. My freshman year of college I received a Minor in possession charge, got deferred disposition, but I never got around to getting it completely wiped from my record.

About a week ago, (2 weeks after I accepted the offer) I received a charge for public intoxication, and pleaded not guilty. I'm a junior now, and wasn't worried about my earlier charge being too much of an issue, but the repeat offense, as well as it happening so recently has me worried that my offer may get rescinded. I still haven't gone to sign off for my background check, but should I just ask the HR people if this is going cause my offer to be rescinded. I think pending cases show up on a background check, but I'm freaking out right now so any advice/personal experience would be great for me.

The definition of public intoxication or a MIP charge depends on which state you live in. In Texas, for example, they are considered class C misdemeanors, which are essentially the equivalent of a traffic ticket, unless you are a minor. This means it should not have much of an impact on your background check unless you are interning for the CIA. My advice to you is to go check in with a lawyer; there is usually a law office close to campus that specializes in this kind of things. For a minor offense like this, they will probably charge you very little.

It's a class c where I'm from, Im just really worried because it happened so recently and both cases involve alcohol, which may raise a red flag because I'm a repeat offender with this stuff now. I'm going to get a lawyer to help get it dismissed, but my court date isn't even until late april, so I imagine the background check will occur before then, and legal issues usually take so long to resolve so a lawyer really wouldn't be able to do much. I feel like I should tell them, explain the situation (pending cases apparently show up on background checks, and i feel like "public intoxication, pending" looks really bad to a potential employer.
