one more try - please read and give feedback

hey guys i've posted this a couple times and have recieved decent feedback, but nobody reads unless it's a new post so please let me know if you can give any insight to my situation:

I recently accepted an offer at GS for a summer analyst position. Over winter vacation, I was caught at the wrong place at the wrong time and was given a civil infraction for possession of marijuana - I was in a vehicle where they found MJ, but it wasn't mine (the weed or car), and yes, in my hometown a MJ possession is just a civil infraction, not a misd., which the police officer kind of used as the basis for issuing it despite the fact I wasn't in possession....he kept saying "don't worry it's like a speeding ticket it wont be a criminal offense on any background check, etc." ANYWAY, obviously I got the ticket dismissed, but unfortunately for me the record of the ticket being issued remains in the cout records, with the offense listed (poss. of MJ) and the disposition as "dismissed on payment of costs by motion of the city attorney". **I do not know what is written in the police report...would they take a look at that despite it being dismissed?

My criminal record is completely clean, but I am kind of trippin out about my background check and feel that this is really going to screw me and I'll have my offer rescinded, despite the fact I wasn't convicted. I put a lot of hard work into getting on the street and this would be devastating as well as very humiliating.

sorry for the long message, but i was wondering if anyone has any feedback to give on my situation as I can't stop thinking about it... thanks, and please don't post with jokes and stuff, this ain't funny.

Ivan:
Well, nothing personal, but from my point of view, it is very questionnable whether a prospective GS intern should spend his free time with those who use MJ.

hahaha

i'd rather work with this guy than some douche whose idea of a good saturday night in college was a group accounting project

when i did my summer more than a few kids had tickets for public drinking, urinating in public, whatever. Small potatoes. Wasn't GS though, was another bank whose name gets tossed around here a lot.

you made a mistake. Unfortunately GS is not forgiving and their standards are the highest of any bank. Develop a contingency plan.

contingency plan? anything more specific? Interview season is about done - by the time I know the outcome of this there won't be a chance to scrape up something else. Is that what you mean? Thanks

That guy is a fucking idiot. You were charged with a small infraction - NOT EVEN A MISDEMEANOR - and you had it DROPPED. Chill the fuck out. Jesus christ. Unbelievable.

Best Response

Look judging from the response from the top two it seems like they have a perception of what GS is and what GS people are like. No offense but frankly I am quite irritaed with all the general statement of what the Street is like. Unless you have spent more than a summer working on the street then please stop given people near heart attacks with blatant generals and stereotypes.

That said, sumanlst08 don't sweat your colleagues are not angels. Just clear your head and move forward. Its a lesson learn but you don't have to walk around with a scarlet letter. Don't say anything to them. If it comes up then explain yourself & why you didn't tell them. Its a probability game-- just weigh it & play your card. Trust me HR have more to worry about than to run constant b-ground check on you esp summer interns

No, No, No its not in jeopardy but then it maybe. Goodness who knows. However logic leans towards no. You have your offer so they are done with you and your b-ground check. HR has moved on to other things. Dude take a deep breathe!!

WORD Of advise, learn to be calm and stop thinking so hard on this!!!

I hear ya man, and i know i'm stressing over this. But I'm pretty sure the background check isn't done until I sign my offer letter.....

you're getting some bad advice from these guys. banks only care if you've been convicted (or plead no contest) to a felony from what i understand. you weren't even charged with a felony to begin with, and no convictions resulted. you'll be fine. that being said, make sure to be completely upfront during the background check process and disclose everything. banks can't dismiss you (by law - you could sue them) if you weren't convicted, but they can dismiss you if you lie during the background check. just relax and you should be fine.

If you weren't convicted then it's irrelevant, you don't even have to disclose it. I'm pretty sure the applications all ask "were you ever convicted of a felony or misdemeanor?" Since this was neither one, and since you weren't convicted, I'd say you don't even need to tell them.

The only time banks care about things you were charged with, but not convicted of, is when it deals with things like fraud or securities law violations.
