Those who understand real-estate, help me out. "subleasing" issue

Basically, I rent an apt, my lease says no subleasing. A month and a half down the line, my friend wants to move in. I let him, he doesn't pay me any money. is this considered subleasing?

I got a letter from my landlord saying he came to check the heating and saw my roommate. he asked my roommate if he lived here, he said yes. my roommate never mentioned he paid me (which he doesn't). The letter says I broke the contract and will have to pay an extra 200 a month, including all previous months (even though my roommate didnt even live here yet). What could/should I do?

Help me out people.

 

Your roommate is a dumbass for saying that he lived there. He should've said that he was just visiting. The landlord does have a right to ask for more rent, but you can argue that the kid wasn't living there before a certain time etc and try to argue that he isn't paying rent, but of course the landlord will say that it doesn't matter since he is "living there".

I agree, make the roommate pay. You were doing him a massive favor by letting him stay at your place. The landlord showed up and he blew it. Tough nuggets for him. $200/month for a place to stay is hardly expensive. If he can't afford it, he needs a new or another job. I can't believe he works hard at any job and can't afford such a low rent -- unless he is paying child support or something similar, of course. Drug/Alcohol addictions don't fall into this category.

Almost Anybody with a full-time job can scrap together $50 a week. Tell your roommate that he fucked up and has to pay for it.

But please explain your situation first because it might depend. Is the roommate a sex slave lol?

 

In that case I don't think there's any way out of this. I guess you can split the extra $200 and demand your roommate to at least start making good on his share.

Make a big deal about it and he should feel bad about costing you extra money, motivating him to start making good on his due. Then you can just think of it as $25 a week, just a dinner foregone...no biggie.

what city do you live in btw? 950 sounds hella cheap.

Why the hell is your landlord randomly stopping at your place? I would have made sure to be 'contacted with 24 hours advance' of him coming, so you can organize your apartment properly.

You blew it. REAL friends don't screw over their friends like your friends has done. a REAL friend looks out for you, your friend is a fool.

If you live in the city, which I assume you do, it is almost guaranteed that your landlord is doing something illegal. Re-read the lease and try to negogiate, if he refuses then refuse to pay him. It will cost him a lot more to take you to court and it is not worth the hassle for him. Tell him your friend was visitin for 3 weeks while he interviews for jobs in the city and that he is half-retarded and misunderstood the question.

We're paying 200 extra. He says because of the water bill (what the?) and some crap about him needing to be accounted for incase of a fire (how's that cost money).

He was fairly cool, and said the rent will drop back down once he leaves. He'll be "leaving" in a few months.

And as for him paying more? He's not a self-motivated college kid trying to get into ibanking... He's an undecided soph who doesnt really do much but play my ps3, what a champ.

As for why I'm friends with him? Eh, people change after HS, appafrently he didn't, but I can't just drop him, i did him a favor, he screwed me over, ah well. I knew the risk, but that doesnt make him any less of a fucking idiot.

 

That was definitely the shittiest use of pronouns I have ever seen in my life. Of course, it also made sense too.

That said, you need to stop bailing out your friend. Live up to whatever commitment you agreed upon prior, although I would say you're in your right to kick him out as the situation has changed and it has now become a burden on you both financially and mentally (sounds like you're stressing out pretty bad). Bailing out people is exactly what leads them to sitting around playing playstation all day. If you really wanted to do him a favor, help him get a job.
