The court disposition says "stricken off" meaning the case was dismissed. I had my record checked through the FBI and the arrest shows up on my record but I was never convicted. My question is since I was not convicted what are my chances of being hired? Will they deny me employment for this? Again, it happened 10 years ago. Thanks.

 

So, I disclosed 2 hunting violations and was rejected when I hit submit. Both from the same incident when I was 18. If it shows up and they ask, you weren't convicted, so you did not disclose. Now, from my experience, I did the background check after the offer. Never brought up. So they may say "he was arrested for theft and the case was dismissed.". Maybe they rescind or maybe you get the job. Now, they are not going to show up on your doorstep with a job offer by you not applying.

So right now I am in the final stages of interviewing and from what it looks like they will be offering me the position. Yesterday I was asked to submit a complete application where it asks for employment, address, and criminal history. The criminal section asks about convictions (felony and misdemeanor). I am just paranoid if I don't disclose them, even though I know they are not convictions, it will show up on my background and I will look dishonest. However, if I do disclose then when I technically don't have to, it will hurt me from getting the position. What would you do?

 

It depends on what question is asked. I have had applications that have asked "Have you ever been charged with a felony/misdemeanor?" and others that have asked "Have you ever been convicted of a felony/misdemeanor?"

These are obviously very different questions, and it's usually pretty clear what is being asked...I wouldn't lie.

No, you'd be fine because you didn't lie. I have never heard of someone getting in trouble for saying they weren't convicted when they weren't. What I have heard of is having a conviction sealed, someone answering they weren't convicted and then getting in trouble.

 

Thanks everyone for the comments so far. Really appreciated. One more thing, let's say I take your advice and do not disclose the retail theft charge since I was not convicted. When they run a background check the charge will come up since I was fingerprinted. Would the firm view this negatively and rescind my offer? Would it be better to beat honest with them prior to background? Thanks
