It does it through fingerprinting so everytime you were even arrested it goes into the database and it will show up on the background check. If you have any felony charges, you are probably fucked because you can't be FINRA cirtified. No idea how you had a job already. PM me if you have any questions.
Even if stuff is "sealed" or "expunged" it still comes up in the FBI check. My buddy who's a new physician had a "sealed" DUI show up- it listed the whole thing. I'd just be upfront, honesty has a much better payoff.
Not to hijack the thread, but in a standard employer background check if I don't provide my transcripts (was not asked to supply) how do they verify my GPA? Do they just verify that I attended said school and graduated?
Did you neglect to mention your previous drug/dui convictions on your employment application or were you not asked in the first place? Were they felony charges?
I work for mid-market PE group. One of our potential new LPs, a large insurance agency, who recently did an extensive on site diligence session. They did a ton of personal interviewing sessions and ..... are apparently doing FBI background checks on everyone.
What sort of shit is going to come up on this? I failed to mentioned to my superiors that I have a DUI along with 2 drunk in public (both in Santa Barbara county) and some drug/cocaine related offenses.
Im sure as hell not bringing any of this stuff up on my own... But what are the chances this is going to bubble up.

If you checked "no" next to the convictions question, I 'd come clean on it to your HR person ASAP. You said cocaine offenceS- plural.
Just say you had a drug problem in college and fess up. Say you went to rehab or something. Assuming you don't still use if they drug test you.
Assuming you haven't yet, do some research to confirm the type of background check they're actually doing. Have you signed something that says it's an fbi background check? Can you find out which 3rd party service they use (kroll, verify, etc.)?
I'd try to run the background check on myself to see what comes up. Once you know what's gonna come up, one route is to go with a personal statement to HR a la AVPGuerilla's suggestion.
Yeah, pretty sure stuff like that would definitely come up. I'm surprised it didn't come up when your current firm hired you. Best of luck with the situation... I think that being upfront and honest is the way to go.

I take it your firm did no background check at all when you were hired? Were you exonerated or convicted? Were you a minor?
Frieds should be able to help at least a little bit.
i guess i was "convicted". I definitely wasn't exonerated.

Edit: unless you got the DUI when coked out of your skull, and the DUI date is the same as the drug conviction. Then they matter.
