what happens to my vacation days if I resign
I am thinking of resigning from my bank after bonus payout in February next year. I am entitled to 15 days leave a year. I am thinking of taking all 15 days leave in January before the payout.
Will the bank make me pay back the excess - can they make the argument that since I resigned in February, I am only entitled to (2/12 * 15) = 1.6 days of leave, and make me pay back in $$$ the remaining 13 days of leave?
There's nothing written on this in my contract with them.
If you are going to ask for 15 days off (entire eligible vacation time) all in January, then you might as well tell them that you are quitting the day after you receive your bonus while you are at it.
You will receive when you resign a cash pay out or true up for all accrued, but unused days. If you use extra days and you are on an accrual system they will make you pay back the extra days.
I second the above. You aren't, unfortunately, entitled to 15 days of vacation January 1 to be used throughout the year - generally, you accrue days as you go month to month - in your case, 1.25 days per month. Therefore, you will only be entitled to 2.5 days for January and Feb (or, depending on how the bank allocates days, you may only get 1.25 days if you leave before March 1, or whatever day it falls on where they record the full prior month). Note, this ignores any rollover days from the previous year that you would be entitled to.
Odds are if you take all 15 days in January, 1) you'll pretty much be saying that you're out of there, and 2) you'll be required to pay the money back for the difference in what you accrued vs. what you took.
