Deferred Comp - What Happens when you leave.
Sry if this is a really dumb question but I’m not a lawyer to understand the terms on paper. If you leave a pod, do you effectively lose all of the unvested comp that’s in the fund or do you get that payout to keep in compliance with non compete?
Truly depends on the nuances of your unique employment agreement. I would hire an employment lawyer.
In most cases, you are paid your base for the duration of the non-compete and forfeit any unvested deferred comp. Hopefully, your new shop can make you whole in some way.
You lose all unvested comp at your old shop but standard practice is for your new offer to at least make you whole on the unvested comp you're leaving behind in the form of a signing bonus
Yes - guarantee should be deferred comp + a bunch extra as well (have seen 2-4x deferred before)
