I don't think the SEC would have brought this case if they didn't think they could get it to trial, and the reputation risks of a trial are probably too massive for GS to contemplate (the media would have a field day with discovery), so I expect this will have to be settled
If GS wins in court, they still loose because they had to go to court and the word "fraud" was involved.
If GS looses in court, the flood gates open and they will hear about this from every lawyer with a JD and a dream.
Loose / Loose situation. Best policy, settle quickly and make it look like they did it to save the tax payers money and to "shore up" the financial system.
I'm sorry, but can I just say to the person that wrote the above mentioned comment, that the opposite of "win", is to "LOSE"....not "loose"... Please..............!
Couple things:
GS had a chance to settle with the SEC before the charges were brought. For whatever reason, they decided not to (either they didn't think the SEC had a solid case, the SEC was demanding too much in reparations, etc...). This case has gone to court because Goldman allowed it to go to court.
As much as I'd love to see justice done, at the end of the day Goldman is just too clever and the SEC too inept for this to ever happen. Had to vote "No" on this one.
Well put edmundo, I completely agree.
Agree that Goldman will beat the wrap. There are a lot of internal emails that have Goldman employees stating that their products were crap but there will also be emails that state the opposite.
People keep saying that Goldman "took the oppposite postion" in trades and transactions but as far as I can see, when I buy Chipoltle Away from Billy Mays, he takes the opposite position in the transaction by selling a product that he recommends I should buy. Taking opposite positions is a requirement of a market maker.
Also, these clients who bought the mortgage securities are not Joe the Plumber, they are sophistiicated institutions that have their own experts.
