can I sign this non-competition form?
I am going to freelance work for a startup company as a consultant for 6 months. After that, I hope I can get an offer from big consulting firms. But now this startup company asked me to sign a non-competition form. Is this form going to affect my future offer from big consulting firms? Thanks.
Non-Competition
Consultant can’t engage in any competitive activity in the Field of Technology ABC during the Term and for 3 years thereafter.
The Consultant hereby agrees that during the Term of this Agreement and for
two years thereafter, it shall not, directly or indirectly through any other
individual, person, legal person or entity, engage anywhere in the world in
any business or activity that competes with the business activities of the
Company.
That's insanely long and geographically ridiculous and would be unlikely to be upheld by a court, especially for a temporary/part-time freelancing job. Even so, I would not sign that.
I would talk to a lawyer, though.
Second that. My experience is that even 1yr non-competes are being laughed at.
I wouldn't have a problem signing it because like mrb87 said, it won't be able to be upheld in court. Since you're freelancing, by them having you sign that they are basically trying to make sure that you're not working for them and someone else at the same time.
I have one that's much shorter, 6 months and more specific no consulting within the space that firm is in, 3 years is nuts.
