He didnt trade on secret information, because when he made the trades it wasn't "information" just yet. So in essence, he crafted a nice little vacuum for himself :D
I'm not sure what the exact parameters for insider trading are, but it sure as hell sounds like he was front-running the deal. It's pretty fucking unethical either way.
I am actually wrting my master thesis about "insider trading as a credibility measure for marketing activities (product launches)".
