Testing for MJ (Federal vs State Guidelines in NYC)

I know this "will I be tested for MJ" question has been asked 100000x, but wanted to ask a more clarifying question about the law itself:

  • Can an employer drug test an employee if federal law allows for drug testing? No, an employer cannot test an employee for cannabis merely because it is allowed or not prohibited under federal law. However, an employer can drug test an employee if federal or state law requires drug testing or makes it a mandatory requirement of the position.

My question is if an INTERNATIONAL employer (EU Bank) can test for MJ in NYC due to federal regulation or do they have to abide strictly by NY laws which say they aren't allowed to screen for MJ? I'm gonna think no unless someone says there's a weird loophole where they can..

The federal law thing only applies if there is literally a federal law on the books requiring you to test for stuff like that - very small number of jobs like airline pilot or school bus driver, things where you clearly would have major federal safety issues. Does not apply to banking analysts.

International banks which do business in NYC are required to abide by NYC laws. You will not be tested, end of story. You may still be tested for coke, unprescribed Adderall, etc, but not weed.
