Oscar Pistorius case

Anyone watching 20/20 on ABC right now on Oscar Pistorius?
There are some eerie similarities to the O J Simpson case. In both cases the evidences for murder appear overwhelming yet the defense prove to be ineffective, incompetent and downright dishonest.

In this case, the prosecutor's credibility has already been stained, having lied about evidences they found and contaminated the crime scene. It looks like a God send for Oscar and his defense team. I think there is a real chance that Oscar can pull this one through and get away with self defense.

One man's home is his castle and if the defense can prove to the jury that Oscar had reasons to believe that an intruder was in his house then he is more than justified to open fire in self defense. This is especially the case given the rampant security concerns in Africa.

So how would you structure your argument if you were Oscar's defense team?

If it were me, I would take a cue from Cochrane & Co and assiduously assault the prosecutor's credibility and lead the jury to believe that the prosecution had a grudge or prejudice against Oscar (admittedly this would be much easier to accomplish if the accused were of the same ethnicity as O.J).

In the best scenario, we can try to have this case dismissed on the ground of mis-trial. I hope they can find a South African version of Alan Dershowitz for this.

What really bothers me is that the media and the prosecution is splattering the whole world with pictures of this centerfold blonde model as if the attractiveness of the victim should somehow sway the legal process. I thought justice was supposed to be blind, yet here they are pandering to the feeble minds with all these pornography.

For this reason alone, I hope that Oscar Pistorius is acquitted.

Well, one thing is for sure: he shot and killed her. That is the big difference between this and the OJ case (besides the racial issues). OJ still denies that he killed anyone. From what I understand about South African law, he will likely be found guilty of something because he shot someone from behind a closed door, which by their definition, did not pose an imminent threat. This means he likely faces jail time. The big question is did he murder her or was it an accident?

Not sure if he walks...

According to evidence gathered by the prosecution, he fractured her skull with a cricket bat before shooting at her. This is rather difficult to explain away as an accident.

I don't know much about SA legal system but I think at this point his best hope is have the judge declare all evidences collected by prosecution inadmissible and have the case dismissed.
