My theory is that the Trump administration proposed something absolutely ludicrous, so when he proposes his actual plan it will seem reasonable in comparison. The art of the deal, ladies and gents. Homeland Security Act of 2002...

Just like when Obama pursued the policy of not pursuing illegal immigrants in certain circumstances, the actual authority and discretion lies with the Secretary of Homeland. Which is why he wrote his statement using the same verbiage as the law giving him said discretion.

There's no chessmater side to this. Trump is a moron and one check on his power worked.

 

It was reported that the Department of Homeland Security originally advised to exempt green-card holders. Obviously, the administration, in its infinite wisdom, must have ignored this advice. I'm glad that the EO has now been modified.
