Is it okay to include client's name in resume if they did not disclose advisor names publicly?
Hi, the situation is that my firm recently closed a deal with a client who traditionally does not disclose the names of advisors in their press releases (this time, too). However, according to the advisor agreement we signed with them, there seems to be no problem for our firm to disclose the fact that we advised on the deal and to discuss the deal based on publicly available information, as my MDs have already begun to do.
My question is, in this situation, is it okay for me to include the client's name on my resume for recruiting purposes? Seems like a bit of a gray area.
Based on the most helpful WSO content, here are some considerations for including a client's name on your resume when they have not disclosed advisor names publicly:
Advisor Agreement: Since your advisor agreement allows your firm to disclose that you advised on the deal and discuss it based on publicly available information, it seems permissible to mention the client's name.
Public Information: Ensure that any information you include on your resume is publicly available and does not breach any confidentiality agreements.
Firm's Practice: If your Managing Directors (MDs) are already discussing the deal publicly, it indicates that mentioning the client's name might be acceptable within your firm's practices.
Recruiting Purposes: For recruiting purposes, it is generally beneficial to highlight significant deals you have worked on, as long as you adhere to the guidelines set by your firm and the advisor agreement.
Gray Area: If you are still uncertain, it might be wise to seek explicit permission from your firm's legal or compliance department to ensure you are not violating any policies.
In summary, while it appears permissible based on your advisor agreement and your firm's practices, it is always best to confirm with your firm's legal or compliance team to avoid any potential issues.
