Shoplifting and Background Check - PLEASE help

So I made an account to just ask this question, because I have a good buddy who is really stressing out right now and has noone to go to for advice. I apologize in advance for the length, but it's quite a complicated story.

Basically, he has an offer for SA with a BB but he's worried about his record.

He just fessed up to me that about 6 years ago, he was caught shoplifting in a pharmacy (something small like a facewash or something). I was quite surprised to hear this but he seems really upset/remorseful and i don't think it would help for me to be judgemenal at the moment. I've known him for a while now and he's a truly a very good guy (albeit one that made a dumb mistake), and I hate to see him like this and really want to help him out. I have no clue and couldn't offer him any advice, so I thought you guys at WSO would be knowledgeable about things like this.

Since he was 18 at the time, the security decided to be lenient on him and didn't call the cops. However, he was banned from the entire building/mall by the security there for 1 year (or something like that, can't quite remember the length). The problem was that, since he worked part-time for another firm within the same building/mall, the supervisor at the firm was immediately notified of this crime by the building security and informed of the no-trespassing condition. Surprisingly, they didn't fire him for that, but instead held a meeting (i presume with HR) and worked out a deal with the security that he could go to work through the side door of the building. He stayed with them for 2 years after this incident (no idea why) , before he resigned for another job.

Becuase the cops were never called and he never went to court, I'm guessing there is no criminal record of this?

He is freaking out about 2 things: 1) When he lists the previous employers on his background check form dating back 5 years, this firm will have to be listed. If they are contacted by the background check agency, will they disclose this information? I'm assuming something like this will stay in their HR records. Would it be better not to list this employer- and could he get in trouble for not doing so? He never listed the part-time job on his resume.

2) So he told me about this national retailer theft database, where retailers supposedly list offenders. Do BBs have access to this/check this? I should note that he is from Canada. Is there a list like this in Canada as well?

Thank you for your help everyone. I truly think he's a great person who despite past mistakes has definitely turned his life around. I'd hate to see him lose an offer he worked so hard for over something like this.

The problem is not so much that the BB is super good at background checks - It's that the BB typically contracts a professional background check agency to thoroughly vet new hires. These background check firms (e.g. First Advantage) in my experience have been extremely thorough - they do these things for a living.

 

Karypto, I'm guessing you were never charged either? I think he's more worried about what will come up during the employment check when the HR of the company is contacted. Granted, I told him for sure to not put them down as a reference, but the background check forms seem to indicatethat he has to indicate all employment in the past 5 years?

 

ibhopeful, do you think these said agencies would contact these retailer theft databases? The cops were never called and he has no criminal record as I mentioned, which is why he didn't disclose when asked if he's been convicted of a crime

 

I agree that "your friend" shouldn't worry about it. If it's not on record, you're fine. I have speeding tickets that are on record for 2 years max (I'm not sure) or if you take defensive driving and remove it from your record (but that works once every two years, again, not too sure).

Another option is to just not list your minimum wage type jobs on your resume. There isn't that much value add from those, imo.

 

Guys who fucking cares if it is "lol his friend ;)" or actually him. That joke is so lame and you all are fucking losers for thinking it would be funny. Your advice shouldn't deviate from person to person so stop being socially deprived tools.

 

pretty sure you're in the clear. petty things like this don't show up on your background check. you just need to check what kind of mark it left on your record.

I know this is all paranoia now, but I performed a free "Been Verified" background check on myself. Nothing criminal came up. This is the same information a bank or F500 company would see, correct? And also could anyone answer my question about interns being background checked? If my PWM internship definitely background checked me and found nothing I will feel much better! Thank you
