Could Brexit be overturned?

"Brexit legal challenge wins: Theresa May must get approval to trigger Article 50, High Court rules. Ruling hailed as 'the chance to say no to an irresponsible hard Brexit that risks our economy and our jobs'" - Independent

  • What does this mean? Could this actually stop Brexit or will it just be overruled?

Difficult to say...basically it means that parliament will be able to vote on it before it happens, theoretically they could vote against it and block the withdrawal but personally I can't see that happening on the basis that most MPs represent constituencies that voted to leave.

Two important points however

1) The government will appeal the decision - case will be heard on 7 December which could overturn this 2) If parliament does have to vote, it could drag the process out even longer - my friend who works in the civil service reckons it would take several years at which point we'd be due another election and the whole process will basically start again if we haven't left by then

True - 480 MPs were voting Remain, 159 were voting Leave and 11 were undecided, however roughly 421 out of 574 English and Welsh Westminster constituencies probably voted to Leave while all 54 Scottish constituencies voted to remain (the referendum wasn't actually counted on a constituency basis so the results can't be transposed exactly).

But MPs are shit scared of losing their jobs at the next election/being deselected immediately by their local party so will probably go with their constituency.

At least to me, it's a deeper issue than whether or not an individual is for or against leaving. The deeper issue is about government by the consent of the governed. When about half the nation does not recognize the legitimacy of the institution that governs it (in this case, the European Union), then how can it be legitimate? Even if I'm an MP who, in principle, supports staying, I have to be thinking that the EU does not have the consent of the governed.

The EU's collapse is inevitable. Maybe not today and maybe not tomorrow, but this ruling is just delaying the inevitable. As the EU faces more and more challenges from groups/countries seeking to leave or seeking fundamental reform the EU will do what every dictatorship does--tighten its grip. A grip tightening will either accelerate the EU's collapse or delay the collapse, which will more closely resemble the Soviet Union collapse.
