Article 3 of 14th Amendment is pretty clear Trump may not run again because he tried to overthrow the Republic.
Its clarity depends on who you ask about the meaning of an "Officer of the United States." I believe the term does include the President. It would not make any sense to exclude the POTUS from this clause. If the POTUS is excluded form the term, it means the President is above the law, an argument that is often associated with Nixon. I think the more difficult part of section 3 is whether Trump contributed to the insurrection directly or indirectly. Trumps actions before the election, during the election and after the election clearly suggest that he was a contributor to the insurrection. Rhetoric aside, I think the most damaging aspect of his actions is related to how he delayed protecting the Capitol.
Knock it off. His oath of office includes something about upholding the office of president. Nothing about January 6 fell within the scope of his duties. January 6 was a strike at the Republic and you’re trying to claim the Constitution doesn’t allow citizens to protect our country? The Constitution isn’t a suicide pact.
Yes, the right to vote is a foundation of the American Republic. But another foundation of the Republic is losing candidates respecting the will of the electorate. Trump refused to do that and instead attempted to overturn the election. That’s insurrection and article 3 of the 14th Amendment bars insurrectionists from running for public office.
I was on Capitol Hill on January 6 and watched those dirtbag hillbilly scum try to wreck the right of Americans to pick their president. If it were up to me, I’d have put every single one of them on trial for their lives, the charge being attempted overthrow of the government.
If convicted, the easiest sentence would have been life in prison. The ring leaders, Trump chief among them, would have had a noose put around their necks and a trapdoor open under their feet.
