If things don’t open up by the new start dates, probably not. If they do, then I’m assuming they’ll give interns a week to do it either before or during at a third party lab or in their office.

If you’re in NYC, non-government/health companies are prohibited from requiring “a prospective employee to submit to testing for the presence of tetrahydrocannabinols or marijuana in such prospective employee’s system as a condition of employment.” The law is scheduled to go in effect on May 9, 2020.

Whether you stay clean or not probably won’t matter as much until a) things clear up and/or b) it gets closer to the virtual/physical start date.

 

You might be working for my firm because I think only 1 or 2 of the firms you listed explicitly put it in the offer letter (in addition to onboarding). Unfortunate answer is that I'm not sure. Anything with HR is so hectic rn with COVID, so I don't think they've even figured it out. We all got them when we were coming in, and I think it's probably 60/40 that they'll still schedule them, just closer to start. Sucks, but probably better to be safe since it's in the offer letter.

Every state has their own workplace drug testing laws. Even if they’re NY-based that doesn’t guarantee they’ll halt drug testing in their regional offices because they need to comply to different state laws regardless.

I’m assuming if they were to make changes to offer letters from a legal standpoint, they would incorporate an excerpt that makes NY-based interns an exception to drug testing. As reference, NY even recommends HR/Legal at financial services firms to make adjustments to their contracts: “The law takes effect on May 10, 2020, financial services firms should review their drug- testing policies and any other documents relating to pre-employment drug testing (e.g., employment applications or offer letters) in order to ensure that they do not violate the new restrictions, and they should consider that New York City may just be an early adopter of this type of law. Additionally, firms should train human resources personnel, as well as supervisors and managers, on any changes made to current policies and practices in response to the changing landscape regarding marijuana and any changes pursuant to the new New York City law.”

Regional offices must comply with the state laws they reside in, regardless if the firms are NY based. In another example, even international banks have to comply with American state laws.

I’d lay off of it once you reach the timeline it takes for your body to detox prior to the week before your start date.

kinda freaked out that they might move the drug test around for full time. Does anyone know if this could be in the cards?

I haven't gotten my background check/drug test for my SA role and I'm nervous that they might not wait until the spring of next year to do it.
