NDA woes

A former colleague is thinking about joining the group I left a while ago. The group was a shit show with some of the worst assholes I have ever worked with, and I left as soon as I could find another role (< year). How much can I say to my former colleague (who I don't know super well) without breaching my NDA? Basically I need them to get the sense that they should give it a wide berth, without being liable for defamation. Thx!

Based on the most helpful WSO content, when dealing with a situation where you're bound by a Non-Disclosure Agreement (NDA), it's crucial to tread carefully to avoid legal repercussions. Here are some general tips that might help you navigate this tricky conversation:

  1. Stick to the Facts: Share objective information about your experience without giving away any confidential details covered by the NDA.

  2. Focus on Your Feelings: Instead of making potentially defamatory statements about individuals or the company, you can express how the job made you feel and why it wasn't the right fit for you personally.

  3. General Advice: Offer broad advice about the importance of company culture and finding a good team fit, without directly bad-mouthing your previous group.

  4. Encourage Due Diligence: Suggest that your colleague do their own research, such as reading reviews on platforms like Glassdoor or reaching out to current employees to get a sense of the work environment.

  5. Discuss Industry Norms: Talk about what is generally expected in terms of work-life balance, management style, and team dynamics in your industry, which can provide context for your decision to leave.

  6. Be Vague if Necessary: If you're worried about breaching your NDA, it's better to be vague and non-specific. You can say things like, "It wasn't the right place for me, but everyone's experience is different."

Remember, the goal is to avoid disclosing any proprietary or confidential information while still being honest about your experience. If in doubt, it's always wise to consult with a legal professional before discussing matters related to your NDA.
