You may find that many if not almost all firms will not make offers that violate non-compete obligations and while they will make offers with start dates far in the future after the non-compete expires for the right candidate I suspect that is less common at firms with low hiring bars. If you accept such an offer with a start date far in the future after your non-compete expires and then renege on the offer there are also potential reputational consequences from that.

Obviously a lot will depend on jurisdiction, the exact contract and the attitude of your previous employer but may also be worth trying to negotiate something more favorable with your ex employer regarding the non-compete clause.
