Form U4 - Will My Current Company be Notified?

Don't really know where to ask this question so I thought I'd ask here. For context, I'm currently on the buy-side and have received an offer from a broker-dealer/bank that I like. If I sign the U4 before notifying my current firm, will that become public info or will my current company be able find out in any way? Don't want my name to pop up with compliance before resigning etc. Just want to cover all my bases here. Thanks!

Based on the most helpful WSO content, when you sign a Form U4 as part of joining a broker-dealer or bank, it does initiate a process that could potentially make your move public. The Form U4 is used to register individuals with the appropriate regulatory bodies and the information is entered into the Central Registration Depository (CRD) system, which is accessible by regulators and member firms.

However, it's not typically a public disclosure that would immediately alert your current company, but there are some nuances to consider:

  1. Timing and Discovery: If your current firm actively monitors the CRD or has compliance procedures in place to check for such changes, they might discover your registration with a new firm. This isn't common practice for all firms, but it's a possibility.

  2. Regulatory Notices: Certain regulatory notices might be sent to your current firm once you're registered with a new broker-dealer, especially if you hold licenses that require transfer.

  3. Discretion is Key: To avoid any premature disclosure, it's best to wait until you have a solid offer and have taken the necessary steps with your new employer before you start the U4 process. As mentioned in the WSO threads, ensure that you have a formal offer letter, it's signed by you, and you have confirmation from the new employer's HR that the position is final before making any moves.

  4. Professional Courtesy: It's generally considered professional to notify your current employer before making any regulatory filings that could alert them to your departure. This is in line with the advice given in the WSO Networking Guide, which emphasizes the importance of maintaining good relationships in the industry.

Remember, while the U4 process itself might not directly notify your current company, there are indirect ways they could find out. It's always best to proceed with caution and ensure that you're ready to transition before initiating any formal registration processes with a new employer.
