Ineligible for rehire

Fired for cause for performance and was told that I would be ineligible for rehire. Has anyone been rehired after told that they won’t be able to come back? My old team wants me back cause I was a high performer in that business, prior team to the one I was fired by.

Based on the most helpful WSO content, here are some insights:

  1. Rehiring After Being Laid Off:

    • It is possible to come back after being laid off, especially if the layoff was not related to performance. For instance, one user mentioned that they were let go due to a tough decision unrelated to their performance, and two MDs promised to give references whenever needed. This indicates that rehiring can be feasible if the circumstances of the layoff were not performance-related.
  2. Challenges with Rehiring After Being Fired for Performance:

    • Being fired for performance can complicate the possibility of being rehired. Companies often avoid rehiring individuals who were let go due to performance issues to mitigate risks and maintain team morale.
  3. Navigating Rehiring with Support from Former Team:

    • If your old team wants you back and you were a high performer in that business, it might be worth exploring this option. However, it will likely require strong advocacy from your former team and possibly higher management to override the ineligibility status.
  4. General Advice on Being Fired and Rehiring:

    • Transparency and framing your experience positively can help. For example, being upfront about the firing but focusing on what you learned and how you improved can be beneficial during interviews.
  5. Legal and HR Considerations:

    • HR departments often advise managers to be vague about the reasons for firing to avoid legal issues. If you were fired for "poor performance," HR might only confirm your employment dates and not delve into specifics if contacted for a reference.

In summary, while being rehired after being fired for performance is challenging, it is not impossible, especially with strong support from your former team. It will require careful navigation and possibly addressing any HR policies that might be in place.

Yes both are ib, different coverage. So i switched over to the recent team because it was a new team but the business flopped so they made a bs performance case to fire without giving severance. However, my previous team where i was 2 years prior is open to bringing me back after speaking to the md who knows the quality of my work pretty well.

i've seen people marked not for rehire brought back within 1-2 years. MD had a ton of clout.

...would say  this is applicable to your case bc the team that canned you was low rev or non-rev. if revenue generators want you back - there is a path.

Assuming the former team is aware of your recent performance related dismissal and they still want you, then I see no legal / HR issues.

what?  you don't get canned from a team, you get canned from an organization.  a 'not eligible for rehire' is supposed to be applicable across the board, even if you tried to join the events and marketing team.  Doesn't mean it'll be enforced, but yeah - not a team specific clause.
