If rape was absolutely legal, do you think that rape cases would increase/explode?

To be honest, I don´t really have an answer to the question.

Would you think that some men would exploit the "loophole", even though the general consensus is that commiting rape would be morally wrong?

Their society and it’s inhabitants would regulate themselves, such as in third world countries/tribes.

Law enforcement can only act on an infringement when they can identify a suspect, the individuals enforcing would just be different in this scenario. There may be an uptick since they may or may not believe they can get away with it more times than not. But there very much would still be a counter active force even if it was not illegal.

This is an extremely out of pocket question tbh…

 

1. A large chunk of rape is from family members, this would skyrocket

2. Since murder or assault is illegal but rape isn't then it would be prohibitively hard to get retribution.  If your daughter gets raped, you kick the guys ass and get an aggravated assault charge, then what?  You're in prison and the guy could rape her again if he wanted.  And if you thought rape in prison was bad before, well now its fully legal

3. Family members are not effective law enforcement officers.  I mean the cops aren't always right but some guy with a day job is not going to be able to track down a suspect.

So no, self-regulation would not prevent any rapes.  

 

Would it increase?  Likely marginally, but in reality most people do not have uncontrolable urges when it comes to sex.  Would people be more aggressive?  Yes, but I don't believe that the number would explode.  We can witness this in animals, with the exception of ducks, rampant forcible rape, as we understand it, isn't a wide spread reality from what I understand.  Humans might be an exception but I don't think we as a species are any more violent than many species in nature.  The fact that rapists are viewed as almost the lowest of the low in prison says alot.  The only thing worse are pedos.

Rape is illegal now and it doesn't stop some people. I think it's pretty obvious that if it weren't a crime it would happen more frequently. The idea people are inherently moral and will not abuse a system is idiotic (hence why all socialists and communists are idiots).
