Garden Leave - PE/PC Associate

All - currently an Associate at a PC firm (please disregard my title). Looking to move a move to another PC firm but have a 2-month garden leave in my current contract. I can see if my current employer will negotiate, but am not sure if that is likely given I would be going to a competitor. Is this usually an issue for moving to a new firm? I have not received an offer from the new PC firm (although later-stage) but they asked about my notice period / ideal start date - would they actually consider not hiring me because of the garden leave?

I don't know the exact process, but it's meant to force employers to not do a criminal background check until they've already given a "conditional offer"... having hired several people lately the background checks took forever and we couldn't give them a full offer for over a month. We complained to HR and they said it would be the same annoying process anywhere in NY.

The recruiting firm (third party firm) was acting like the garden leave was such a big deal and was being very pushy to get me to ask about it or find someone who left the firm recently and ask if they were able to negotiate the garden leave. Of course I can ask my firm once I resign (once I have a written offer in hand) but it’s unlikely they’ll reduce it since I’d be going to a direct competitor. You’re sure it’s not a huge deal? Why was the recruiting firm being so pushy about it?
