Is this illegal? Avoiding Gift tax?

Hi everyone,

Lets say I want to gift 20k to my son. Obviously I can pass on 14k without inuring any gift tax but can I give $6,040 to my cousin (pay him 40 dollars lets say so cover wiring expenses, etc) and have him gift 6k to my son? where dem pwm folks at? It seems like if I wanted to I could do this (x1000) and gift my son tons of money tax free? That is assuming I knew 1000 people I actually trusted with to give the money back.

I'm sure it is, but I couldn't tell you the exact reason why. But, something to do with fraud.

Plus, you can give over $5 million away right now without owing gift tax. It just cuts into your estate tax exemption when you die. Tons of my friends have been taking advantage of this over the last few years, especially at the end of 2012, when we thought this exemption might be eliminated.

 

You have 2 options:

1) Payout $14,000 this year and you gift the rest ($6,000) in the next year.

OR

2) You can gift $14,000 and your wife can gift him $6,000. Couples can combine their annual exclusions. Which means you and your wife can give a $28,000 gift to the same recipient tax-free. This is perfectly acceptable. The rule comes from Internal Revenue Code § 2513.
