ACD and future finance career
I received an ACD (adjournment in contemplation of dismissal, i.e. after the 6-month period all charges will be off the record ) for "195.05 obstructing governmental administration." Essentially I got in trouble for questioning some despotic cop about why he was taking my friend home (not evening arresting) and not even questioning the bouncers after he got beat the shit out of by bouncers at a bar - but that is besides the point. So, I currently work at BB in IBD which obviously FDIC regulated employer. When the time comes to pivot somewhere else (assuming another Bank which is FDIC regulated), will this be visible on a background check. Although I am profoundly unfamiliar with the law, I have ascertained that under Section 19 (a) of the FDIA ("Section 19"), which prevents the hiring of "any person who has been convicted of any criminal offense involving dishonesty or a breach of trust or money laundering, or has agreed to enter into a pretrial diversion or similar program in connection with prosecution for such offense." It seems as though an ACD falls under the "pretrial diversion" category, but given my offense did not involve "dishonesty or a breach of trust or money laundering," I am hoping I should be okay under these circumstances. If anyone has any insight or experience on this, comments would be appreciated.
