Failed Background Check: Dismissed due bad performance
I was let go from my old firm as an analyst. I have now secured an offer but was informed from a friend at that place, that the firm calls people from your former employers to check upon you.
Now, when I applied to the new firm I was still employed at my old firm and let off during the interview process. I did lot volunteer and tell the firm I was interviewing that I have been let go.
Now I am scared that the new firm will call my former firm and inquire about me. I did get a reference upon leaving the firm which wasn’t too bad. However, I am afraid of the informal chats e.g. one associate calls another one or a Partner calls a MD.
Thanks
Based on the most helpful WSO content, here’s how you can navigate this tricky situation:
Leverage Your Reference: If you received a reference upon leaving your old firm, ensure that the person providing it is aware of your current situation. Prep them to focus on your strengths and avoid discussing the circumstances of your departure. A solid reference can help mitigate any informal negative feedback.
Control the Narrative: If the topic arises during the background check or later stages, be prepared to address it calmly and professionally. Frame your departure as a mutual decision or a result of misalignment in goals, rather than focusing on "bad performance." For example, you could say, "I realized that my long-term career goals were better aligned with opportunities outside my previous firm."
Minimize Informal Risks: While you can’t completely control informal chats, you can reduce the risk by listing references who are supportive and unlikely to share negative details. Avoid listing anyone who might have a biased or unfavorable opinion of you.
Be Proactive if Necessary: If you suspect the informal chats might reveal unfavorable details, consider addressing the situation proactively with your new employer. Transparency, when done tactfully, can build trust. For instance, you could say, "I want to be upfront about a challenge I faced at my previous firm. While I didn’t meet certain expectations, I’ve taken steps to improve and have strong references to vouch for my abilities."
Legal Protections: Remember that most large firms only provide basic employment verification (dates and title) to avoid litigation risks. However, informal chats can bypass this. If you suspect any slanderous comments, consult an employment lawyer for advice.
Stay Calm and Confident: Employers value candidates who can handle adversity with professionalism. Focus on your achievements and the value you bring to the new role.
By preparing your references, controlling the narrative, and addressing concerns proactively, you can navigate this situation effectively.
