What’s wrong with someone doing what’s best for themselves within the law? And it looks like they did get support from congressman.

That’s not true. Companies are required to offer an interview to any American citizen or green card holder who meets the minimum requirements for the role—meaning every qualified candidate. Typically, companies set very low minimum requirements for these positions because they can’t be too specific in their job listings due to PERM regulations, especially with the Department of Labor actively monitoring compliance nowadays. If they don’t follow this, they’re violating the law.

So, in short, as long as you meet the basic requirements, like having a college degree, the company must interview you if you're a citizen or green card holder. If they don’t, the need for the H1B could be challenged, and the PERM process for that H1B holder is likely to fail. You should let congressman know that that H1B holder’s PERM test will fail.

If you work in Wall Street long enough, you will realize that many MDs are very aggressive and value people who will do whatever it takes to achieve their goals. 

I can understand why this method works because Wall Street dislikes uncertainty and wants to phase out H1B for junior positions. 

In my opinion, those from non-target have nothing to lose because they won't pass the resume screen otherwise. If copy congressman can help them get an interview, that’s already a win.

 

I think a lot of the tension between H1B workers and American employees has escalated recently, mainly due to the weak U.S. job market and the high youth unemployment rate. I wouldn’t say either side is entirely wrong, but I do believe a country needs to prioritize its own citizens, even if it means disrupting the lives of foreign workers. Companies are always looking for cheaper labor, but they also want to avoid operational risks and poor government relationships. Just look at how many Wall Street firms have scaled back their DEI hiring initiatives.

So, I can understand why the approach OP mentioned makes sense now—maybe not in the past, but with the current administration in place, companies need to factor in these political and economic realities.

 

I have a feeling that soon there will be an industry dedicated to helping students with green cards or citizenship secure those junior H1B positions, using the method you mentioned earlier. Similar to cybersecurity, the industry is built on many allegations, but there's real money involved. Financial professionals are skilled at profiting from the lack of trust in humanity, and if what OP did can generate income, I believe many people will follow suit.

 

It's a complete lie when companies claim they can't find qualified Americans for analyst or associate roles and have to rely on H1B visas.

Anecdotal data points but I have seen this worked for FAANG SWEs. Can argue they are more prestigious than IBD although their headcounts are like 5-10x of IBD every year.

A few things here

  • You are likely to get an interview if you apply lateral for this. This is an HR thing, because there is a political pressure to at least interview and weed you out. Your MD may not like it but unfortunately HR has their own agenda and they will likely ask the business to interview at least
  • Because of this, it is actually not a very bad move to practice your interviews - you may not get the offer as the interviewers are pissed + these are usually PERM positions which they already have someone they want to hire in mind but ok to brush up your skills and waste their time to practice
  • In an unlikely scenario, you are a good candidate and they just don't want to hire you, the PERM process for the candidate is their mind is sabotaged by you so you gain nothing besides a practice but they cannot extend visa to a foreigner
  • In a very unlikely scenario (happened more commonly in SWEs as even lateral interviews can place you to another teams at some shops), you ace the interview and get the job
