International Student: Options If Not Selected For H1B?
Hey WSO,
I am an international student joining a top BB (GS/MS) as an IB SA.
Assuming the internship goes well, and I get a FT offer, I am curious to know what would happen if I am not selected for the H1B during my first year as an analyst? I only have a 1 year OPT from my school due to being a non-STEM major, and thus only have one shot at getting the work visa.
Would GS/MS be open to transferring me to one of their foreign offices (London/Singapore/HK) since my home country has neither bank's office in it? And then would I have a chance to transfer back to the NYC office?.. I would appreciate any insights!
1) Did you use your CPT at all? why/why not? 2) In one full year you technically have two H1b attempts, if your sponsor is willing to go for it 3) It happened in various cases that BBs put you into a NAFTA location and then moved you back into the US, i.e. Canada. I do not know whether they will do it going forward. I would ask. 4) EU nations would also require sponsorship, but they are easier to get. 5) You can work in the US during the cap gap if H1b was filed correctly.
There are a few risks at hand where we do not know the exact outcomes: - Due to the huge number of applicants right now (covid 19), this entire scenario is way more difficult - There might (!) be pressure on the administration to defer certain visa programs
Good luck.
like Gumball3000 said, you technically have 2 H1B attempts. Additionaly, you can go back to college for a Masters and then have one more year of OTP (or a 2 year stem extension if you qualify depending on your masters). Worse case-scenario you can try to find work at a college campus as they don't have the H1B cap like normal jobs outside of campus/non-profits.
I know someone at MS who was transferred to the London office after not winning the H1B lottery after a year, but that was a few years ago, unsure if anything has changed with policy
Usually they’ll transfer you to a non-US office (e.g. London) for a year and then bring you back as an intracompany transfer on an L-1 visa.
but seems like L-1 visas are only given to people in managerial positions tho!
Not entirely correct. L1A is for executives and managers, L1B is for SMEs/specialized knowledge staff.
it is a good route to go if nothing else works out.
Normally the H1b visa would be the correct one for this purpose, but with all the visa fraud from Indian body shops it is no longer a reliable way.
with the new online registration system you'll get 2 chances at the H1B, assuming u did SA and got FT offer (say you're interning in 2020 and graduating in 2021, you can apply for both the 2021 and 2022 H1B cycles)
great! just to clarify so you can apply for 2021 opt before you technically graduate in June?
Assume you mean H1B instead of OPT - yes, you can register online in March and receive the result of your lottery by March 31, and then you have 90 days from April 1 to file for a H1B petition, so as long as you graduate by end of June you're good.
At least that's this year's process. Never know if they'll change it up next year. Dm me if you have q's
.
It’s quite expected that international banks will relocate you to a different office (mostly London). I have seen a case when a guy was transferred from NYC to London from IBD to Admin and then transferred back to NYC after some years.
what is the best option? asking the bank to transfer to London/other offices with easier visa policy and then coming back with L1 visa, asking them to try the lottery for me again next year, doing a one year stem master with 3 year opt and starting one year later?
what is the best strategy? asking HR with whom I have been in contact with (Junior Talent Dep. HR) or the Head of HR CC'ed in my "not selected" email by the immigration lawyers, or do I also reach out to the assigned senior mentor, or the VP and/or MD from my division?
There is not much HR can do at this moment + they most likely have no clue what to do in the first place. You need to apply for the H1B lottery and see what the outcome is. The most common practice is that an immigration law firm will handle all your fillings and they will advise on what to do if you don't get your H1B.
Marriage isn't as easy at this age, with no job, income, prospects and as an immigrant on top of that. USCIS will assume it won't be a bona fide marriage and comb through every piece of paper.
only reasonable way would be another degree and then try this again.
Sounds like the system worked. We’re full, go back.
