Investment banking internship with criminal record

Hello WSO,

For anonymity I’m going to keep names and roles pretty vague but I've recently been offered an off-cycle internship at a UK investment bank and about to commence the background checks.

A few years ago, I got into an altercation with a police officer and received a conditional discharge. This is a very low level conviction in the UK (comparable to a caution) and there was no subsequent punishment following the discharge, however, is still recorded as a conviction nonetheless.

Inevitably, I knew this would be a conversation I’d have to have with HR at some point, as I’d expect them to now perform an enhanced DBS check which would show my conviction. This has not come up in any of the interview screening or online assessments thus far, so I’m not in a position where I have falsified anything to HR.

I’m now super stressed because I’ve worked ridiculously hard to land this internship and worried my offer is going to be rescinded. My friend (BB ER analyst) says HR should be pretty chill if I’m forthcoming and explain the situation given that this is a non-financial conviction and low severity. It’s seems they’re more concerned from a visa perspective for any travel implications this could cause with away jobs.

How should I approach this with HR / am I cooked lol?

Shouldn't be an issue. Even visa-wise, if this was discharged you aren't likely to run into issues.

I would not proactively bring this up. It'll of course come up in the background check and you'll have a chance to explain it / show that it was discharged, but saying to HR out of nowhere "hey btw I have a conviction but it's actually fine" is kind of odd. As you said, being low-level and non-financial is the key here.

Based on the most helpful WSO content, here are some insights and advice on how to handle your situation:

  1. Be Honest and Forthcoming:

    • It's crucial to be upfront with HR about your past conviction. Transparency can work in your favor, especially since you haven't falsified any information so far.
    • Explain the context of the conviction, emphasizing that it was a low-level offense and that there was no subsequent punishment.
  2. Focus on the Non-Financial Nature:

    • Highlight that the conviction is non-financial and of low severity. This can help mitigate concerns about your integrity and trustworthiness in a financial role.
  3. Emphasize Your Commitment and Hard Work:

    • Stress how hard you've worked to land the internship and your dedication to the role. This can help HR see your value beyond the past incident.
  4. Prepare for the Conversation:

    • Be ready to discuss the incident calmly and professionally. Show that you have learned from the experience and that it has not impacted your professional conduct.
  5. Consider Potential Visa Implications:

    • If there are any potential visa issues due to the conviction, address them proactively. Show that you are aware of these concerns and are prepared to handle them.
  6. Seek Advice from Trusted Sources:

    • Your friend's advice that HR might be understanding is valuable. It might also be helpful to consult with a legal professional to understand your rights and how best to present your case.

Remember, honesty and professionalism are key. Good luck!
