Thank you for the link. I didn't find anything in the article particularly alarming, nor was there any indication Obama was circumventing his Constitutional powers. Influencing policy, even if it crosses federal/state jurisdictions, isn't all that uncommon.

All I had to do after reading that article was view the comments stating that Obama's clearly following "The Third Reich" in his national agenda and that everyone should all watch FOX news. People are so fucking ignorant. I don't see anything out of the ordinary in that article, or anything that is un-constitutional. Just a writer trying to stir up trouble with routine shit.

Considering that ~130MM people voted in the 2008 election, about 1/3rd the US population, I think Congress is truly the will of the people.

Besides, the President is not supposed to usurp the power of Congress just because he wants to. Obama could get things done if he was more willing to work with them.

I guess the will of the people = letting Congress insider trade also, right? They could have won 10% of the entire vote and still be elected, thanks to the US not enacting Run-off voting. This is the dumbest thing I've ever heard. Obama could get things done if he was more willing to work with Republicans? That isn't "getting things done" at all, especially with the party of "no" who have been shown to vote against Obama's policies even when they were in direct alignment with initiatives put into place by Republicans themselves (tons of times). Can't you see how absurd your party is when half of you are crying out that Obama is, literally, Hitler?

The President has limited powers at best. Congress is the embodiment of representative government. And who fucking cares about congress being able to trade off information. The economy sucks, we are in two wars and there are a myriad of other issues to be dealt with. If the people truly give a shit about that one issue they should do something about it.

Obama has no interest in working with Republicans. He wants to jam his policies through any way he can. Just wait until the Republicans take the Senate. Obama will have to get real creative then.

Any true scholar of the legislative art form would know that Obama's powers are clearly questionable at best and, even with his choice of underhanded tactics, can still have his will overturned by both the legislative and judicial branches. He won't be able to push an agenda without the involvement of Congress - it's just a fact that requires some basic understanding of the Constitution. His powers are fairly limited, and if he plans to enact serious policy, he will need congressional approval if it requires any capital expenditures. None of his actions will qualify under any emergency powers action (the IEEEA - I forget the acronym - comes to mind) and even if he does try to do a "temporary cum pseudo-full appointment" or create a new czar's office, he will need to get approval from congress lest we have another "Elizabeth Warren" situation on our hands. It's all speculation.

His powers are limited on a national level, however if he convinces enough state governments to adopt policies there is a way he can "nationalize" these policies in the face of simplifaction of the law if it is in the best interest of commerce. It is an obscure part of the commerce clause.
